These Terms of Service (“Terms”) are an agreement between you and [Legal entity name], [Registered business address], Kenya (“Monifyx”, “we”, “us”), for your use of the Monifyx website, web app and Android app (the “service”). By creating an account or using the service you accept these Terms, our Privacy Policy and our Data Protection Policy. If you do not agree, please do not use Monifyx.
1. The service
Monifyx is a personal finance tool. It organises financial information you bring in or authorise (such as receipts, M-Pesa, bank and SACCO transactions, loans and savings) and shows you your spending, money in, budgets, reports, net worth and savings suggestions. Features may change over time as we improve the service.
Monifyx is not a bank, payment service, lender or financial adviser. It does not move money, make payments on your behalf or hold funds.
2. Your account
- You must be at least 18 years old and give accurate details when you sign up.
- Your account is for you only. Do not share it or let others use it.
- Keep your password and devices secure, and tell us straight away if you think your account has been misused. You are responsible for activity under your account.
- Free trials are limited to one per person.
3. Free trial
New accounts may receive a free trial for the period shown in the app. Some features may be limited during the trial. When the trial ends, your account becomes read-only: you can still see and download your information, but adding new information and paid features need a subscription.
4. Subscriptions and payment
- Plans, prices and what each includes are shown in the app before you pay. Prices are in Kenya shillings (KES) and include any applicable taxes. The price shown when you pay applies; we may change prices for future payments.
- Payments made through M-Pesa in the app or on the website do not renew automatically. Paying again adds the days of the plan you choose to the time you have left; paying during a free trial starts the plan when the trial ends.
- If you subscribe through an app store (such as Google Play), that store's billing, renewal and cancellation terms also apply.
- Access is given as soon as a payment is confirmed, so payments are not refundable, except where we made a mistake (for example a wrong amount, or a payment that did not unlock your account) or where the law requires a refund.
- If a subscription ends, your account stays with your information in it, read-only, until you subscribe again or delete it.
5. Your information and our licence
You own your financial records, receipts and the other information you bring into Monifyx. You give us a limited, non-exclusive licence to host, process, organise and display that information only to provide, secure and support the service for you, and as described in the Privacy Policy. This licence ends when your information is deleted, except for copies we must keep by law or that remain for a limited time in backups and logs.
You confirm that you have the right to bring in the information you add, and that you will only authorise Monifyx to read financial messages and statements that belong to you. You are responsible for the content you add. Do not upload unlawful content or content that infringes anyone else's rights; we may remove or disable access to such content.
6. Automated processing and accuracy
Monifyx uses automated processing, including artificial intelligence, to read receipts, messages and statements and to suggest categories. This can sometimes be wrong or incomplete. Please check important figures; you can correct or delete any record. Monifyx is not a substitute for official statements from your bank, M-Pesa or other providers.
7. Not financial advice
Reports, budgets, forecasts, price comparisons and savings suggestions are for information only. They are not financial, investment, tax, credit or legal advice. Decisions you make about your money are your own; consider getting professional advice where appropriate.
8. Acceptable use
You agree not to:
- use Monifyx for anything unlawful, or to process information you are not entitled to;
- share your account, create accounts to get repeated free trials, or abuse payments, promotions or invitations;
- overload, disrupt, probe or attack the service, or try to get around its security or usage limits;
- copy, scrape, reverse engineer, decompile or try to extract the source code, models or methods behind Monifyx, except where the law expressly allows it;
- use the service to build a competing product.
9. Intellectual property
Monifyx, including its software, design, features, methods for reading and organising financial information, algorithms, models, text, graphics, name and logo, is owned by us or our licensors and is protected by law. These Terms give you a personal, limited, non-exclusive, non-transferable right to use the service for your own, non-commercial purposes; they do not transfer any ownership to you. You may not rent, lend, sell, resell, sublicense or redistribute the service or the app, or create works based on them. Your own information stays yours (section 5).
10. Availability and changes
We work to keep Monifyx available and reliable, but we do not guarantee that it will always be available, uninterrupted or error-free. We may carry out maintenance, and change, add or remove features. If a change significantly reduces what a paid plan includes, we will tell you in advance.
11. Suspension and termination
- You can stop using Monifyx and delete your account at any time (⚙ → Account → Delete my account).
- We may suspend or close an account that breaks these Terms, puts the service or other users at risk, or where the law requires, and will tell you where we reasonably can.
- We may act immediately, without notice, where we reasonably suspect fraud, money laundering, other unlawful activity or a serious security risk.
- After an account is closed, information is deleted or kept as described in the Privacy Policy.
12. Third-party services
Monifyx works with services run by others, such as Google sign-in, M-Pesa, app stores and the providers listed in the Privacy Policy. Their own terms apply to your use of them, we do not control their availability, and using them with Monifyx does not mean they endorse Monifyx.
13. Limitation of liability
To the extent permitted by law, Monifyx is provided “as is”, and we are not liable for indirect or consequential losses, lost profits, or losses caused by inaccurate information, by decisions you make using the service, or by events outside our reasonable control. To the extent permitted by law, our total liability to you for any claim relating to the service is limited to the amount you paid us in the three months before the claim. Nothing in these Terms limits rights you have under Kenyan consumer protection law that cannot be limited.
14. Indemnity
To the extent permitted by law, you agree to cover us for claims, losses and reasonable costs brought by others that arise from your breach of these Terms or your misuse of the service.
15. Governing law and disputes
These Terms are governed by the laws of Kenya. If you have a complaint, please contact us first so we can try to resolve it. Any dispute that cannot be resolved informally will be subject to the jurisdiction of the courts of Kenya.
16. Changes to these Terms
We may update these Terms. We will change the date at the top and, for significant changes, tell you in the app or by email before they take effect. Continuing to use Monifyx after that means you accept the updated Terms.
